TERMS AND CONDITIONS
We are very happy to have your child as a pupil at Lady Evelyn Independent School. To maintain the high standard of education you and your child deserve, we have a simple set of conditions that form the agreement between you and the school. Please read them carefully to ensure that you and your child are happy with them.
These Conditions form a legally binding agreement for the provision of educational services.
This agreement sets out the terms and conditions upon which a place has been offered to your child. By accepting a place for your child as a pupil you agree to be bound by these terms and conditions. We have endeavoured to draft this document in clear language, free, where possible, from legal jargon. It is, however, legally binding on both Lady Evelyn Independent School and you. In this document the term ‘parents’ is frequently used. Guardians are included within the meaning of that word.
This agreement will remain in force until your child concludes the end of Year 11 and all fees have been paid. If your child joins in Year 12 or 13 then the agreement remains in force until your child reaches the end of Year 13 and all fees have been paid in accordance with Condition 5 below.
3. AUTHORITY OF THE HEAD TEACHER
Parents authorise the Head Teacher of Lady Evelyn Independent School or their nominated deputy to take such action as the Head Teacher may consider to be in the best interests of the pupil on a day to day basis.
4. PROVISION OF EDUCATION
The Lady Evelyn Independent School will do all that is reasonable to provide an educational environment and teaching of a range, standard and quality which is suitable for each pupil.
The Lady Evelyn Independent School cannot guarantee that the Pupil will achieve his or her desired examination results or that results will be sufficient to gain entry to other educational establishments.
The fees and other expenses payable and the timing of such fees are set out on the Lady Evelyn Independent School website.
The Lady Evelyn Independent School makes every effort to hold fees stable for each academic year. However, the Lady Evelyn Independent School reserves the right to increase fees at any time; any increase will be notified to you at least 30 days before the increase takes effect. The liability to pay fees and all other expenses is the joint and several liability of the people who have signed the Conditions of Attendance.
A pupil whose fees have not been paid in full or in accordance with an agreed fee payment plan before the start of term may at any time be excluded from attending until full payment is made. Parents are liable to pay all costs, fees, disbursements and charges including legal fees and costs reasonably incurred by Lady Evelyn Independent School in the recovery of any unpaid fees regardless of the value of the claim.
The Confirmation of Entry Fee is a deposit which is only refundable upon completion of an academic year, receipt of public exam results by the Head Teacher, if applicable and payment of any outstanding fees.
The Confirmation of Entry Fee for non-UK resident Pupils is equal to one school terms fees.
6. NOTICE PERIOD
Parents can withdraw their child at any point by giving notice to leave the school. Notice of withdrawal can be given by email to [email protected].
Notification by any other means including by telephone is not valid. It is expected that there will be prior consultation with the Head Teacher before the withdrawal of a Pupil.
For pupils in year 4, 11 or 13:
Pupils in years 4, 11, 13 are liable for fees for the entire academic year – there is no option to give notice to leave the school at any point prior to the end of the academic year.
For pupils in year 5, 6, 7, 8, 9, 10 or 12:
Notice to withdraw a pupil can be given at any time. If the notice results in a pupil leaving the school at any point prior to the end of an academic year, a leaver’s fee of £500 will be applied. This will not apply if the child completes and pays fees for the full academic year. Notice for the pupil to leave at the end of an academic year, must be received no later than the last day of scheduled lessons for the school in the Summer Term. The leaver’s fee is a pre-estimate of the School’s loss in these circumstances, and often, the actual loss is much greater. This rule is necessary to promote stability and the School’s ability to plan its staffing and other resources.
For the avoidance of doubt, if notice is not provided by the last day of scheduled lessons for the school in the Summer Term then the pupil will be deemed to be continuing for the following academic year and the notice clause for the relevant year will apply.
Lady Evelyn Independent School acknowledges the importance of respecting the privacy of pupils and we consider their best interests at all times. Pupils will have the opportunity to appear on our website and in our social media in many ways, including in photographs, video, sound recordings and posts.
